ACDP welcomes sentence handed to Julius Malema

The African Christian Democratic Party (ACDP) welcomes the sentence handed down to Mr Julius Malema in the KuGompo Magistrates Court in the Eastern Cape.

Magistrate Twanet Olivier sentenced Mr Malema to five years direct imprisonment and fined him R60 000.

The ACDP believes that today marks a moment which reinforces one of the most fundamental principles of our democracy – that no one is above the law. The Court found that Mr Malema was guilty on serious charges, stemming from the 2018 Mdantsane Rally, which includes unlawful possession of a firearm and ammunition, discharging of a firearm in a built-up area, and reckless endangerment amongst others. These are not minor infractions, but they are offences which put lives at risk and undermine public safety.

What matters today is not the individual alone, but what this outcome represents for our constitutional order: that the law must apply equally to all in South Africa – whether a private citizen or prominent political leader. Accountability cannot be selective, and the strength of our justice system lies in its ability to act without fear, favour, or prejudice.

This case sends a clear message that equality before the law is not just an ideal but a practice that must be upheld consistently. Our courts have demonstrated that they remain committed to this principle and that justice will be pursued regardless of who stands before them.

As citizens, this should strengthen our confidence in the rule of law and remind all South Africans that accountability is the foundation upon which a just and orderly society is built.
